2. The petitioner is in custody in a case registered for the offence punishable under Sections 103(1), 3(5) of the BNS.

3. As per allegation in the FIR, it is a case of murder of the father of the informant by the petitioner and other coaccused persons.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that nothing incriminating article has been recovered from the possession of the petitioner. Petitioner is in custody since 13.05.2025 and he has got clean antecedent as stated in

Patna High Court CR. MISC. No.52351 of 2025(3) dt.15-10-2025 2/2 para-3 of the petitioner.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

6. On perusal of first information report, case diary, postmortem report and FSL report, it appears that the postmortem report does not establish clear connection against the factum of the case and FSL report shows that there was no metallic alkaloidal, glycosidal, pesticidal or volatile poison could be detected in the contents therein. It also appears from the postmortem report that the doctor has not found any external or internal injury on the body of the deceased so, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Sheohar in connection with Purnahiya P.S. Case No.85 of 2024.
