This application is for grant of regular bail in connection with Khagaria P.S.Case No.56 of 2017 dated 2.2.2017 G.R.No.261 of 2017 for the offences under Sections 504, 307 & 326/34 of the Indian Penal Code.
The petitioner is named in the F.I.R. and the case is under Section 307 and other Sections of the Indian Penal Code. It is submitted on behalf of the petitioner that there is no specific allegation against the petitioner rather same is on other co-accused persons and only allegation against the petitioner is that he was also present along with the other co-accused persons at that time.
Heard learned A.P.P. also, who has opposed the prayer for
Patna High Court Cr.Misc. No.20023 of 2017 (2) dt.08-05-2017 2/2 bail stating that apart from the fact that he is named in the F.I.R. he is still accused in ten other cases.
Having heard both sides and in view of criminal antecedent, I am not inclined to grant bail to the petitioner at this stage, however, considering the fact that the petitioner is in custody since 11.3.2017, the learned trial court is directed to expedite the trial and try to conclude it within a period of six months and if not concluded, the petitioner is at liberty to renew his prayer for bail. With the aforesaid observation, this application is dismissed.
