JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-08-2019 Petitioners seek bail in anticipation of their arrest in connection with Khagaria (Muffasil) P.S. Case No. 300 of 2019 registered for the offences punishable under Sections 341, 323, 379, 384, 307 of the Indian Penal Code and Section 27 of the Arms Act.

Prosecution story is that petitioner No.1 made firing on the informant which did not hit anyone and petitioner No.2 snatched gold chain worth Rs.30,000/- from the Bhabhi of informant and petitioner No.1 has also pushed the Bhabhi of informant, causing injury on her head and petitioner No.3 demanded Rs.1 lac as extortion.

No.52358 of 2019(2) dt.22-08-2019 2/2 Submission of learned counsel for the petitioners is that informant and petitioners are Gotias and no such occurrence has taken place and a dispute arose with respect to construction of boundary wall and FIR itself shows that there is no serious injury on the person of informant and any other injured. Heard learned APP also.

In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria, in connection with Khagaria (Muffasil) P.S. Case No. 300 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
