The petitioner seeks bail in connection with Shastri Nagar P.S. Case No. 90 of 2017 registered for the offences punishable under Sections 341, 323, 504, 506, 332, 353 and 289 of the Indian Penal Code.

Allegedly, to vacate the government quarter, the informant and other police personnel went at the flat and then the petitioner caused threats to them that if they will enter into the quarter then they will open the dog to bite them and ultimately, the petitioner opened the dog but anyhow the dog was taken in possession and the petitioner was abusing the police force and magistrate and started altercation.

Patna High Court Cr.Misc. No.18685 of 2017 (2) dt.10-05-2017 2/2 Submission is of false implication and that the flat has already been vacated. The petitioner has been implicated in this false case. The petitioner used to oppose the illegal acts of the informant and other officials resulting, he has been implicated in this case and he is suffering in custody since 15.02.2017. The learned A.P.P. opposes the prayer of bail. In the facts and circumstances stated above, considering the detention of the petitioner now he is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Judge-IV-cum-Additional Chief Judicial Magistrate, Patna in connection with Shastri Nagar P.S. Case No.

90 of 2017 subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
