JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-12-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act and sections 414/34 of the Indian Penal Code. As per the prosecution case, 211 liters of foreign liquor was recovered from two cars and petitioner has been named by the apprehended accused persons.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way concerned with the alleged recovery. Petitioner is neither the owner nor the driver of the vehicles in question Petitioner is in custody since 18.9.2021. Investigation is complete.

Considering the rival submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the court concerned in Punpun Police Station Case No. 206/2020 Special Case No. 5287/2020, once the charge is framed in the case.
