JUSTICE SATYAVRAT VERMA ORAL ORDER 04-02-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State through virtual court proceedings. Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioners seek regular bail in connection with Uchkagaon P.S. Case No. 227 of 2021 instituted for the offences under Sections 272, 273 of the Indian Penal Code, Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018 read with Sections 25(1-b)a, 26 and 35 of the Arms Act. Learned counsel for the petitioners submits that the petitioners are in custody since 17.07.2021 and charge-sheet has been submitted in this case.

Allegation is of recovery of one country made loaded

Patna High Court CR. MISC. No.64678 of 2021(2) dt.04-02-2022 2/2 pistol and four cartridges and 536.960 litre of liquor from the house of petitioner no. 2.

Learned counsel for the petitioners submits that petitioners have been falsely implicated in the present case and they stayed in a joint family property and, as such, were not known who had kept the liquor in the house.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioners.

Considering the fact that the petitioners are in custody and charge-sheet has been submitted, let the petitioners above named be released on bail on furnishing bail bonds of Rs.5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise, Gopalganj in connection with Uchkagaon P.S. Case No. 227 of 2021.
