JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 18-10-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Jamui Mahila P.S. Case No. 27 of 2016, registered under Sections 323, 354(b), 380, 452, 504, 376 and 511 of the Indian Penal Code. The accusation is that petitioner entered in the court yard of the complainant/informant and tried to commit rape upon her by unfolding her clothes. When complainant made alarm, then he moved from there. Thereafter, complainant made complaint then other accused persons, named in the complaint petition, caused injury to her through fists and lathi and at that time, Md. Aftab took cash of Rs. 7,000/- and also given threatening to kidnap her daughter. Learned counsel for the petitioner submits that petitioner is the brother of the husband of the complainant/informant and due to dispute of lane, this false case has been lodged with allegation of

Patna High Court Cr.Misc. No.38847 of 2016 (2) dt.18-10-2016 2/2 attempt of rape by this petitioner, which is the basis of the present case.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the SDJM, Jamui in connection with Jamui Mahila P.S. Case No. 27 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
