The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 414/34 of the Indian Penal Code and Sections 30(a) 41(i) of the Bihar Prohibition & Excise Act. There is recovery of 5 litres of illicit liquor from a Maruti Suzuki Alto Car.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner was not

Patna High Court CR. MISC. No.62461 of 2023(6) dt.03-04-2024 2/2 apprehended from the spot. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern either with the seized vehicle or the apprehended accused person. A supplementary affidavit has been filed to the effect that petitioner is accused in two other cases apart from the present one. Considering the facts aforesaid, let the petitioner, above named, in the event of his arrest or surrender within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Judge-II-cum-Special Excise Court No.-I Gopalganj in connection with Gopalganj Town P.S. Case No. 603 of 2020.
