This application is for grant of anticipatory bail for the offence under Sections 304B, 201 and 34 of the Indian Penal Code.

It has been submitted on behalf of the petitioners that the petitioner no.1 is mother-in-law, petitioner no.2 is married 'Nanad', petitioner no.3 is Fuferi Saas' and petitioner no.4 is 'Unmarried Nanad' of the deceased.

A supplementary affidavit has been filed that the petitioner no.1 (Lilawati Devi) is the wife of Kisun Sahani and the

Patna High Court Cr.Misc. No.45324 of 2016 (3) dt.16-12-2016 2/3 petitioner No.4 (Sindhu Kumari) is the daughter of Kisun Sahani. It has been submitted on behalf of the petitioners that there is omnibus allegation in nature against them and a compromise petition has been filed by the informant in the court below.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts that all the petitioners are lady as well as the allegation is omnibus in nature, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of CJM, East Champaran at Motihari in connection with Motihari Muffasil P.S.Case No.47 of 2016, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure, however, with a condition that they will cooperate in the trial and they present themselves in court below as and when required.
