This is a petition for grant of regular bail for offences under Sections 30(a) and 47 of the Bihar Excise Act, 2016.

From the vehicle, on which the petitioner was also a seater, four cartons of liquor was recovered. Submission of the petitioner is that similarly situated co-accused, Ashutosh Kumar @ Pappu, has already been allowed bail by a coordinate Bench of this Court in Cr. Misc. No. 122228 of 2017. the petitioner is in custody since 24.12.2016.

Considering the aforesaid fact, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Hasanpur P.S. Case No. 269 of 2016 to the satisfaction of the Additional Chief Judicial Magistrate, Rosera, Samastipur, or successor Court with the condition that the petitioner shall fully cooperate with the

Patna High Court Cr.Misc. No.14382 of 2017 (2) dt.04-04-2017 2/2 investigation/trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner.
