JUSTICE BIRENDRA KUMAR ORAL ORDER 16-05-2017 Heard the learned counsel for the petitioner, learned counsel for the State as well as learned counsel for the informant. This is a petition for grant of regular bail for offences under Sections 304(B), 201 and 120(B) of the Indian Penal Code. The petitioner is husband of the victim lady. The victim died within a year of her marriage. The allegation is of demand of dowry and torture. The main allegation of commission of murder is against the petitioner.

Submission is that there is no eye witness of the occurrence.

To prove the charge of the dowry death, there is no need of eye witness. The victim died during a year of her marriage in unnatural circumstances, as a result of torture for not meeting

Considering the aforesaid facts, I am not inclined to enlarge the petitioner, above named, on bail. Hence, the prayer for bail of the petitioner is refused in connection with Koilwar P.S. Case No. 226/2016.
