In this case, the petitioners are apprehending their arrest in connection with Kusheshwar Asthan P.S. Case No. 29 of 2017 registered for offences under sections 147, 148, 149, 447, 341, 323, 307, 379, 504 and 506 of the Indian Penal Code. Learned counsel for the petitioners submits that there is a case and counter case from both sides and persons from the petitioners' side including petitioner have also received injury in the altercation. There is a dispute of land. There is no specific allegation against the present petitioners save and except causing

Patna High Court Cr.Misc. No.6028 of 2018 (2) dt.02-02-2018 injury by Lathi on the hand. It has further been submitted that other accused persons, namely, Rajendra Paswan, Upendra Paswan @ Opindra Paswan and Sopindra Paswan have been granted anticipatory bail vide order dated 12.12.2017 passed in Cr. Misc. No. 58593 of 2017.

Looking to the entire facts and circumstances of the case, let the petitioner, namely, Devendra Paswan @ Devanand Paswan @ Devanandan Paswan, Sadanand Paswan @ Sadanand Paswan and Gulshan Paswan, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Biraul, Darbhanga in connection with Kusheshwar Asthan P.S. Case No. 29 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
