This application, for grant of anticipatory bail, arises out of Kotwali (Adampur) P.S. Case No. 85 of 2016, disclosing offences under Sections 409 and 420 of the Indian Penal Code.
Patna High Court Cr.Misc. No.42007 of 2016 (2) dt.30-09-2016 2/3 The allegation against the petitioner is of not making available to the Vigilance Bureau team, the registers and folders relating to the appointments made to the posts of Panchayat Teachers, illegality of which is being inquired into by the Vigilance Bureau.
The petitioner is In-Charge Secretary of Deendayalpur Gram Panchayat and Gobrayan Panchayat, in the district of Bhagalpur. It is not alleged in the First Information Report that the said documents were in his possession, which he refused to supply or he misappropriated or got disappeared the same.
Considering the facts and circumstances of the case, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with Kotwali (Adampur) P.S. Case No. 85 of 2016, subject to the condition laid down under Section 438
(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of
