Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 342, 379, 406, 497, 498, 504, 506/34 of the Indian Penal Code. The prosecution case is that the informant was married to Arvind Kumar prior to the lodging of the case. The petitioner being the relative of the husband of the victim used to visit her house. Consequently, the informant was taken by the petitioner after misleading her with her ornaments and clothes, when this petitioner ravished her. The informant was confined in the house of Nishu Devi. Subsequently the informant was released from the confinement with the help of her in-laws.
It is submitted by the learned counsel for the petitioner that petitioner claims to be juvenile, let the learned
Patna High Court Cr.Misc. No.56341 of 2015 (2) dt.11-12-2015 court below consider the question of juvenility or any prayer made under the Juvenile Justice (Care and Protection of Children) Act, 2000 in accordance with law.
With this observation this application is disposed of.
