JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-03-2017 The petitioner seeks regular bail in connection with Sabour (Goradih) P.S. Case No. 121/2013, registered for offences punishable under Section 302 and 120(B) Indian Penal Code. It has been submitted on behalf of the petitioner that earlier the bail application of the petitioner was twice rejected by this court and though the trial is going on but uptil now only four witnesses out of ten, have been examined and also other coaccused of this case has already been released on bail an petitioner has been languishing in judicial custody for more than one year. Heard learned A.P.P. also.
Having heard both sides, from perusal of the impugned order, it appears that the trial in this case is in progress and out of ten witnesses, four have been examined, considering this fact, I am
Patna High Court Cr.Misc. No.10257 of 2017 (2) dt.06-03-2017 2/2 not inclined to grant the petitioner, the privilege of regular bail, at this stage, it is accordingly rejected.
However, the trial court is directed to expedite the trial and try to conclude it within a period of six months and if the trial is not concluded within the aforesaid period, the petitioner will be at liberty to renew his prayer for bail in the trial court itself, which will be considered by the trial court on the merit of the case, without being prejudiced by the order of this Court.
