2. The petitioner seeks bail in connection with Shivsagar P.S. Case No. 189 of 2025 dated 06.06.2025 instituted for the offence punishable under Sections 317(5), 338, 336(3), 340(2), 3(5) of Bhartiya Nyaya Sanhita.
3. The prosecution case, in short, is that one Ajay Kumar Singh informed the police that he owns a Scorpio bearing Registration No. BR02PA6136, Engine No. WGH4C11184, Chasis No. MA1TA2WGXH2C29554. He alleged that someone is using another vehicle having the same registration number, engine number and chasis number as stated above. Thereafter the police personnel went to Toll Plaza and signaled to stop a Scorpio bearing Registration No.
Patna High Court CR. MISC. No.52789 of 2025(3) dt.15-11-2025 2/3 BR02PA6136, Engine No. WGH4C11184, Chasis No. MA1TA2WGXH2C29554, which was being driven by the petitioner. On enquiry, the petitioner said that he has bought the said vehicle from Ambey Motors, Patna.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. Learned counsel for the petitioner submits that he is also the victim of the circumstances. It is submitted that the vehicle in question, was purchased by the petitioner from Ambey Motors through proprietor, namely, Hareram Prasad after making payment of Rs.9,90,000/- for which delivery note was also issued by Ambey Motors on 22.12.2020. It is further submitted that the proprietor of the said company has not handed over the Registration Certificate despite its payment as well as the tax has already been deposited by the petitioner. Learned counsel for the petitioner submits that the proprietor of Ambey Motors has cheated the petitioner. Lastly, it has been submitted that the petitioner is in custody since 06.06.2025 having no criminal antecedents. Charge-sheet has been submitted in the case.
5. Learned A.P.P. for the State opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Shivsagar P.S. Case No. 189 of 2025.
