Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks bail in a case registered for the offences punishable under Sections 366(A)/34 of the Indian Penal Code read with Sections 8 and 12 of the Protection of Children from Sexual Offenses Act, 2012.

Learned counsel for the petitioner submits that the petitioner is in custody since 24.12.2020, is a person with clean antecedent and charge-sheet has been submitted. Allegation is of commission of kidnapping of the minor daughter of the informant by the petitioner along with FIR named accused persons for the purpose of getting her married forcibly.

No.64369 of 2021(3) dt.09-05-2022 2/2 Learned counsel for the petitioner submits that the victim girl has returned and she has not supported the prosecution case, rather she has stated that she has married with the petitioner and has a child out of the wedlock. However, a joint compromise petition has already been filed by the parties in the learned court below.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 24.12.2020, is a person with clean antecedent and chargesheet has been submitted and the victim has not supported the prosecution case and a joint compromise petition has been filed in the learned court below, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Dhankund P.S. Case No. 132 of 2019.
