This is a petition for grant of regular bail for offences under Sections 379, 406, 420 and 411 of the Indian Penal Code.
The driver of the informant, Kundan Kumar, informed that some unknown miscreants snatched the vehicle. The informant suspected that the driver himself, in collusion with his friend, has got the colour of occurrence of robbery.
Submission of the petitioner is that co-accused, Rahul Kumar, has already been allowed bail by a coordinate Bench of this Court in Cr. Misc. No. 7810 of 2017 and only material against the petitioner is suspicion though the petitioner has got no criminal antecedent. The petitioner is in custody since 10.12.2016.
Considering the aforesaid fact, the petitioner, above named, is directed to be released on bail on
Patna High Court Cr.Misc. No.11295 of 2017 (2) dt.20-03-2017 2/2 furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Ahiyapur P.S. Case No. 746 of 2016 to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur, or successor Court with the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner.
