NILU AGRAWAL ORAL ORDER 26-10-2016 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners apprehend arrest in connection with Town P.S. (Siwan) Case No. 299/15 for offences alleged under Sections 420, 465, 467, 471, 406, 120-B of the Indian Penal Code. Allegation is that petitioners along with others demanded rangdari of Rs. Five lakhs from the informant and on refusal threatened him of dire consequences.

It has been submitted by the learned counsel for the petitioners that they are genuine purchasers of the said land and have purchased the land by a bona fide deed of sale. He submits that the dispute is between the alleged owners of the land and that the matter is purely a civil dispute.

Patna High Court Cr.Misc. No.42791 of 2016 (3) dt.26-10-2016 2/2 However, learned APP for the State submits that the petitioners are named in the First Information Report, hence, opposes the prayer for bail.

Be that as it may, since the matter relates to civil dispute, let petitioners, above named, in the event of their arrest or surrender before the court below within a period of eight weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan, in connection with Town P.S. (Siwan) Case No. 299/15, subject to the conditions as laid down under Section 438(2) Cr.P.C.
