The petitioner is accused in connection with Majahidpur (Babarganj) P.S. Case No. 175 of 2016, registered under Sections 379, 411 & 307/34 of the Indian Penal Code and Section 3 /4 of Explosive Substance Act.

Learned counsel for the petitioner submits that it would appear from the F.I.R. that petitioner was not apprehended on the spot rather the name of the petitioner surfaced in the confessional statement of Vikash Kumar Yadav, who is said to be apprehended from the BSFC Godown. The petitioner having no criminal antecedent is in custody since 21.10.2016.

Having regard to the facts and the circumstances of

Patna High Court Cr.Misc. No.14187 of 2017 (2) dt.07-04-2017 2/2 the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge-V, Bhagalpur in connection with Mojahidpur (Babarganj) P.S. Case No. 175 of 2016.
