02-12-2015 Heard Sri Ganpati Trivedi, learned counsel, who was assisted by Sri Ravindra Kumar Sinha, learned counsel for petitioners.

The present petition has been filed with a prayer to restore Misc. Appeal No. 503 of 2013, which stood dismissed due to non-compliance of peremptory order dated 14-10-2014. Learned counsel for petitioners submits that defect regarding filing of certified copy of the judgment has already been removed and he undertakes that in view of defect pointed out by the office, limitation petition shall be filed by 3rd week of January, 2016.

Accordingly, the M.A. No. 503 of 2013 is restored to its original file with an indication that if limitation petition is not filed, in view of earlier order passed in M.A. No. 503 of 2013, by

Patna High Court MJC No.896 of 2015 (2) dt.02-12-2015 2/2 3rd week of January, 2016, the Misc. Appeal i.e. M.A. No. 503 of 2013 shall stand dismissed without further reference to the bench. (Rakesh Kumar, J.) Anay U
