The petitioners seek anticipatory bail in connection with Piro P.S. Case No. 258 of 2017, registered for offences punishable under Sections 147, 148, 149, 120(B), 295 (A), 153(A) 188, 353, 307, 323, 341, 504, 379, 436, 427/34 of the Indian Penal Code and 27 of Arms Act.

As per F.I.R., allegation against the petitioners is that the petitioners along with 500 other persons assembled at a spot and there is allegation of making unlawful assembly and also damaging the temple.

Submission of the learned counsel for the petitioners is that the petitioners named in the F.I.R. but there is no specific allegation against the petitioners and other co-accused persons having similar allegation have been granted privilege of bail by

Patna High Court Cr.Misc. No.43064 of 2018(3) dt.24-07-2018 2/2 different coordinate Benches of this Court on different dates. Learned A.P.P. opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) each with two sureties of the like amount each in connection with Piro P.S. Case No. 258 of 2017 to the satisfaction of learned A.C.J.M.-I, Bhojpur at Ara, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
