Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offences punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 118(1), 118(2), 109(1), 303(2), 352, 351(1) of the Bharatiya Nyaya Sanhita.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and petitioner is alleged to have assaulted the injured by an iron road causing injury on head and the accused persons also snatched gold chain and Rs. 25,000/- from the informant.

It is next submitted that no doubt the petitioner is alleged to have assaulted the injured by an iron road, but then it is submitted that the impugned order records that the injury

Patna High Court CR. MISC. No.55799 of 2025(3) dt.26-09-2025 2/2 suffered by the injured does not corroborate the allegation of assault by a rod as the injury inflicted measures 1 x 1 x 1⁄2 inches. It is further submitted that though the injury has been opined to be grievous but then the blow was not repeated and the petitioner is in custody since 3-5-2025.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the submission made by learned counsel for the petitioner and also taking into consideration the period of incarceration and the fact that petitioner is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Tedhagachh P.S.Case No.80/2024.
