Patna High Court Cr.Misc. No.29903 of 2018 (2) dt.18-05-2018 counsel for the State.

The petitioners seek pre-arrest bail in connection with Uphara P.S. Case No. 8 of 2017 registered under Sections 147, 149, 288, 353, 427 of the Indian Penal Code and Section 3 of the Prevention of Damage of Public Property Act. It is submitted that similarly circumstanced co-accused Ashok Paswan, Guddu Paswan, Dilkeshwar Paswan, Surjeet Paswan and Kamla Paswan have already been granted pre-arrest bail by a Bench of this Court vide order dated 05.04.2018 passed in Cr. Misc. No.13995 of 2018 and another co-accused Satyendra Paswan has also been granted pre-arrest bail vide order dated 05.04.2018 passed in Cr. Misc. No.19862 of 2018.

Learned counsel for the State does not dispute the aforesaid contention advanced on behalf of the learned counsel for the petitioners.

In view of the submission made above and the reasons assigned in the order dated 05.04.2018 passed in Cr. Misc. No.13995 of 2018, in the event of arrest or surrender in the court below within six weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.29903 of 2018 (2) dt.18-05-2018 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Uphara P.S. Case No. 8 of 2017 subject to the conditions as laid down under Section 438(2) Cr. P.C.
