JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER (Per: HONOURABLE THE ACTING CHIEF JUSTICE ) 02-12-2015 Heard Mr. Vikash Kumar Pankaj, learned counsel for the petitioner, and Mr. S.D.Sanjay, learned Additional Solicitor General, appearing on behalf of respondent No.1. Heard also Mr. Lalit Kishore, learned PAAG, appearing for the State, and Mr. Satya Prakash Tripathy, learned counsel for the respondent No.7.

It is submitted, on behalf of the petitioner, that a doctor, who has been given adequate training by the National AIDS Control Organization (NACO), has been posted along with a trained Nurse, Grade-A, at A.R.T.Centre, Sadar Hospital, Chapra, but the doctor and the nurse aforementioned are not available at A.R.T. Centre, Sadar Hospital, Chapra, after 2.00 PM, whereas they were required to be present there till 5.00 PM. Mr.

Patna High Court CWJC No.9699 of 2015 (7) dt.02-12-2015 respondent No.7, namely, the Project Director, Bihar State AIDS Control Society, Patna, submits that the respondent No.7, namely, the Project Director, Bihar State AIDS Control Society, Patna, would ensure that the doctor and the nurse, who have been deputed, at A. R.T. Centre, Sadar Hospital, Chapra, shall remain present there on the duty hours, as prescribed by the concerned authority.

Considering the matter in its entirety and in the interest of justice, we close this PIL with a direction to the respondent No.7, namely, the Project Director, Bihar State AIDS Control Society, Patna, to ensure that the doctor and the nurse, who have been posted at A. R. T. Centre, Sadar Hospital, Chapra, shall perform their duties as per requirements by the National AIDS Control Organization, till 05.00 PM.

We also grant liberty to the petitioner to approach this Court with appropriate application, in future, if such a situation arises.
