The petitioner who is in custody since 22.07.2016 has filed the instant application for grant of bail in connection with Ara Nagar P.S. Case No. 383 of 2018 (District Bhojpur) registered for the offence punishable under sections 406, 420, 120B and 34 of the Indian Penal Code.

As per the allegation in the FIR, the petitioner who is said to be one of the Directors of a Non-Banking Financial Company is said to have lured the ordinary persons in investing their money. The complainant is said to have deposited a sum of Rs. 70,000/-.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.50938 of 2019(4) dt.25-10-2019 2/2 that the allegations against this petitioner are vague in nature. He is in custody since 22.07.2016 and has been enlarged on bail in a number of matters of similar nature, the details of which have been given in paragraph no. 12 of the bail application. It is further submitted that FIR named co-accused person has been enlarged on bail by order dated 11.02.2019 passed in Cr. Misc. No. 7744 of 2019.

The application for bail has been opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the grant of bail to the co-accused as also the petitioner being in custody since 22.07.2016, the Court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Ara, Bhojpur in connection with Ara Nagar P.S. Case No. 383 of 2018 (District Bhojpur).
