The petitioner apprehends his arrest in Kawakole P.S. Case No. 19/2008 registered under Section 307 and other sections of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that the prayer for anticipatory bail of the petitioner was earlier rejected vide order dated 21.12.2015 passed in Cr. Misc. 44919/2015 on the ground that the petitioner moved for anticipatory bail after seven years of the institution of that case and now the case has been compromised. The petitioner belongs to a respectable family and there is no specific allegation against him. Considering the fact that the petitioner sat over the matter for more than seven years and did not move at appropriate time for grant of anticipatory bail, I am not persuaded to change
Patna High Court Cr.Misc. No.49675 of 2016 (2) dt.11-01-2017 2/2 my view. I am not inclined to enlarge the petitioner on anticipatory bail in Kawakole P.S. Case No. 19 of 2008. Accordingly, the same is rejected.
If the petitioner so desires, he may surrender in the court below and pray for regular bail and, on such, the court below shall dispose of the bail petition preferably on the same day, if possible, taking into consideration the fact that the case is compromised.
