JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-07-2022 Heard learned counsel for the petitioner and the State. The petitioner seeks pre-arrest bail in K.Hat P.S. Case No. 476 of 2021, registered for the offence punishable under Sections 376, 323 and other allied sections of the Indian Penal Code and section 3, 4, 5 and 6 of the ITP Act. As per the FIR, petitioner Suraj Kumar is alleged to have forcibly took the informant on his motorcycle and kept at his house. It is further alleged that the accused persons pushed her in flesh trade. Meanwhile, police raided the hotel and apprehended the informant while other persons fled away. It is further alleged that earlier also petitioner had forced the informant to do prosecution.
It is submitted on behalf of the petitioner that the informant is a lady of questionable character. She was indulged
Patna High Court CR. MISC. No.64272 of 2021(3) dt.06-07-2022 2/2 in flesh trade on her own sweet will and when police raided the Hotel and recovered her, she falsely implicated the petitioner. The incident is of three years back. Nobody has seen him abducting the informant. Petitioner's mother owns her own hotel and due to business rivalry informant has implicated the petitioner and his mother in this false case. Learned counsel appearing for the State opposes the prayer for bail. He submits that there is specific allegation against the petitioner that it was he who forcibly took the informant on his motorcycle and kept at his house wherefrom he took her to Katihar and started indulging her in flesh trade with the help of other accused persons.
Considering the specific allegation against the petitioner, his prayer for bail is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice. (Prabhat Kumar Singh, J) shashi/- U T
