====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-09-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Earlier, anticipatory bail was granted to the petitioner vide order dated 14.03.2023 passed in Cr. Misc. No. 49608 of 2022 whereby petitioner undertook to give Rs. 3,000/- per month to opposite party no. 2 as maintenance amount.

3. Petitioner seeks regular bail in connection with Nawanagar (Basudeva O.P.) P. S. Case No. 200/2021 in a case registered for the offences punishable under Sections 494, 498(A), 341, 323/34 of the Indian Penal Code.

4. As per the prosecution case, marriage of opposite party no. 2 was solemnized with this petitioner in the year 2017 and thereafter, it is alleged that this petitioner along with other

Patna High Court CR. MISC. No.52426 of 2025(2) dt.19-09-2025 2/2 F.I.R. named accused persons tortured and harassed opposite party no. 2 due to non-fulfillment of demand of dowry.

Learned counsel for the petitioner submits that in compliance of order dated 14.03.2023, petitioner regularly paid Rs. 3000/- per month to the opposite party no. 2 till July 2024 but later on, he became ill and could not arrange money and due to non-arrangement of the money, he could not continue the same and surrendered before the learned court below. Petitioner is in custody since 21.06.2025. Petitioner claims clean antecedent.

6. Learned A.P.P. for the State vehemently opposed the bail application.

7. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.S.D.J.M., Buxar in connection with Nawanagar (Basudeva O.P.) P. S. Case No. 200/2021.
