JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-01-2017 The present application has been filed for modification of the order dated 19.05.2016 passed in Cr. Misc. No. 47004 of 2015.

Learned counsel for the petitioner confines his prayer to the extent of extending the period of surrender. The petitioner being husband of the complainant was granted provisional anticipatory bail in a complaint case on undertaking of the petitioner to make payment of Rs. 2000/- per month to the complainant from June, 2016 by depositing the same in the bank account of the complainant by second week of every succeeding month. On the grounds mentioned in the modification application, the period of surrender is extended for a further period of three weeks from the date of receipt/production of the copy of this order.

No.55468 of 2016 (2) dt.18-01-2017 2/2 The bail bonds of the petitioner will be accepted bringing on record the up-to-date payment of the undertaken amount as stipulated in the order dated 19.05.2016 passed in Cr. Misc. No. 47004 of 2015. The order dated 19.05.2016 stands modified to the extent as indicated above.

Accordingly the modification application is disposed of in connection with Complaint Case No. 149 of 2014, pending in the Court of learned Sub-Divisional Judicial Magistrate, Jhanjharpur.

It is made clear that rest conditions as stipulated in the order dated 19.05.2016 shall remain the same.
