JUSTICE SUDHIR SINGH ORAL ORDER 17-03-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in connection with Sasaram (Town) P.S.Case No. 735 of 2015 instituted under Sections 147,148, 149, 452, 323, 341, 504, 506, 420, 467, 468, 471, 406, 307, 120(B) and 34 of the Indian Penal Code and 27 of Arms Act.

It is alleged by the informant that all the accused persons including the petitioners armed with katta, knife came at his door and abused him. On protest all the accused persons entered into his wife with intention to kill him and accused Neyazuddin fired upon him and after assaulting him they refused to return the money. It is further alleged that the petitioners and others were aggrieved to sale his house and after agreement they had taken Rs. 2,50,000/- and some times after they refused to sell. It is also alleged that all accused persons with conspiracy to each other

Patna High Court Cr.Misc. No.58574 of 2015 (2) dt.17-03-2016 2/2 executed a sale deed and registered on 5.9.2014 in favour of petitioner no.2.

It has been submitted on behalf of the petitioners that the peittioners have got no criminal antecedent. The matter relates to sale and purchase of property. It is further submitted that no offence u/s 307 IPC is made out. No one was injured in course of alleged occurrence.

On behalf of the State, it is submitted that the petitioners are named in the FIR.

Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Rohtas at Sasaram in connection with Sasaram (Town) P.S.Case No.735 of 2015, subject to the conditions as laid down u/s 438(2) Cr.P.C.
