The petitioner has filed the instant application for grant of regular bail in connection with Sikroul P.S. Case No. 76 of 2022 registered under sections 20 (b) (ii) (c), 22(b) of the Narcotics Drugs and Psychotropic Substances Act. Prosecution case in short is that on the basis of secret information, police personnel apprehended the petitioner after she was fleeing and on search police found 6.50 grams heroine like intoxicating substance from her possession. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. She has falsely been implicated in this present case. Moreover, the recovered contraband is between small and commercial quantity

Patna High Court CR. MISC. No.54630 of 2022(3) dt.16-02-2023 2/2 as prescribed under N.D.P.S. Act. For the same offence, petitioner's son has also been made an accused in this case. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. She is languishing in judicial custody since 19.07.2022.

The application for bail is vehemently opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Sikroul P.S. Case No. 76 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned District Judge-cum-Special Court, N.D.P.S Act, Buxar.
