====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 19-09-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The present application has been filed for modification of order dated 07.03.2024 passed in Cr. Misc. No. 14423 of 2024 by which the petitioner was granted anticipatory bail in connection with Simri P.S. Case No. 278 of 2023 pending before the Court concerned, Darbhanga and the petitioner was directed to surrender in the learned Court below within a period of six weeks and furnish bail bond.
3. Learned counsel for the petitioner submits that due to some unavoidable reasons, the petitioner could not surrender in the Court below within time.
4. It is prayed on behalf of the learned counsel for the
Patna High Court CR. MISC. No.61212 of 2024(3) dt.19-09-2024 2/3 petitioner that the name of the Police Station of the petitioner may be corrected as "Piyar" in place of "Ahiyarpur Sakri".
5. Vide order dated 22.08.2024 a report regarding proper parentage or residential address of the petitioner from the Superintendent of Police, Darbhanga in connection with Simri P.S. Case No. 278 of 2023 pending in the Court of learned Exclusive Special Judge- II Excise Act, Darbhanga, was called for.

In compliance of the aforesaid order dated 22.08.2024, a report from the Senior Superintendent of Police, Darbhanga, vide its Memo No. 535/Vidhi Sakha, dated 17.09.2024, has been received to this Court wherein it has been stated that the proper parentage or residential address of the petitioner is as follows:- "Ravi Kumar, S/o Sanjay Sahni, Resident of VillageSakriman Chandpura, Ward No. 13, present P.S.- Hattha, previous P.S. Piyar, District- Muzaffarpur.
7. It is submitted that further time may be extended so that the petitioner could surrender in the learned Court below.
8. It is also relevant to mention here that earlier the petitioner had also filed a modification application vide Cr. Misc. No. 30593 of 2024 for modification of the order dated 07.03.2024 passed in Cr. Misc. No. 14423 of 2024 for modification of the name of the Police Station as "Ahiyarpur" in place of "Sakri" in
Patna High Court CR. MISC. No.61212 of 2024(3) dt.19-09-2024 3/3 the cause title of the order dated 07.03.2024 passed in Cr. Misc. No. 14423 of 2024 which was allowed by this Court vide order dated 10.05.2024.

Considering the submissions made on behalf of the learned counsel for the petitioner and the grounds mentioned in the present modification application, let the name of the Police Station of the petitioner be read as "Piyar" in place of "Ahiyarpur Sakri" and the period of surrender of the petitioner in the learned Court below is also extended for a further period of four weeks from the date of receipt/production of a copy of this order. The rest of the conditions stipulated in the order dated 07.03.2024 passed in Cr. Misc. No. 14423 of 2024 will be same.
10. The order dated 07.03.2024 passed in Cr. Misc. No. 14423 of 2024, is modified to the extent as indicated above.
11. The present modification application is allowed.
