This application for anticipatory bail arises out of Lalganj P.S. Case No. 21 of 2019, disclosing the offence under Section 409 of the Indian Penal Code.

A supplementary affidavit has been filed on behalf of the petitioner stating that the petitioner has deposited the amount of Rs. 6,31,426/- in the account of New Primary School, Gorouni on 14.10.2019 and 15.10.2019 in the light of the undertaking given by him, as recorded by this Court in the order dated 04.09.2019.

It appears from the order dated 04.09.2019 that it is the petitioner's case that he had executed work for the value of Rs. 3,43,514/- out of total amount of Rs. 9,75,000/- said to have

Considering the statement made in the supplementary affidavit, this application is allowed. Let the petitioner, abovenamed, in the event of his arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in Lalganj P.S. Case No. 21 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/ Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
