JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 22-09-2016 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State.

This application, for grant of anticipatory bail, arises out of Complaint Case No. 595C of 2013, alleging offences under Sections 420, 467, 468, 471, 120B of the Indian Penal Code.

Learned Counsel for the petitioner has submitted that on the basis of what has been alleged in the complaint petition, it is evident that the dispute is, primarily, civil in nature and it is being given colour of criminal case. He has submitted that he would have appeared before the Court below and sought regular bail,

Patna High Court Cr.Misc. No.40557 of 2016 (2) dt.22-09-2016 2/2 but since warrant of arrest has been issued, he can be taken into custody once she appeared before the Court below and, therefore, the petitioner has opted to file this application for anticipatory bail.

Considering the nature of dispute, as alleged in the complaint petition, it is directed that if the petitioner appears before the Court below and seeks regular bail, her application shall be disposed of on the same day taking into account the fact that the dispute is, primarily, civil in nature.
