JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 28-06-2017 Heard learned counsel for the petitioner, learned counsel for the opposite party no.2 and learned A.P.P. for the State.

Petitioner apprehends his arrest in Complaint Case No.2492 of 2015 (Tr. No.1298/16) for the alleged offence registered under Section 498 A of the Indian Penal Code. Petitioner and opposite party no.2 with their respective learned counsels are present before me in Chambers. It has been submitted by learned counsel for the petitioner that he is ready to keep opposite party no.2 (wife) with him with full honour and dignity.

Patna High Court Cr.Misc. No.19216 of 2017 (03) dt.28-06-2017 2/2 that she is also ready to live with the petitioner (husband) peacefully.

Considering the fact that both husband and wife are willing and ready to live together, the petitioner above named is directed to be enlarged on provisional bail for two months on furnishing bail bond of Rs.10,000.00 (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of the learned J.M. 1st Class, Muzaffarpur in connection with Complaint Case No.2492 of 2015 (Tr. No.1298/16), subject to conditions as laid down in Section-438(2) of the Criminal Procedure Code. Both the parties are directed to appear before the learned Court below on 29.08.2017 and if the learned Court below satisfies itself that they are living peacefully and happily should confirm the bail of the petitioner on that date itself.
