Smt. Suman Kumari Singh(APP) ====================================================== CORAM: HONOURABLE MR. JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 05-04-2018 Heard learned counsel for the petitioners and learned counsel representing the State.
The petitioners apprehend their arrest in connection with Mirganj P.S. Case No. 09 of 2018, registered for the offences punishable under Sections 363 and 366-A of the Indian Penal Code.
Allegedly, Puja Kumari aged about 15 years the daughter of the informant was kidnapped by Pintu Gautam with an intention to marry with her and the petitioners have assisted him.
Submission is of false implication and that the statement of the victim girl has been recorded under Section 164
Patna High Court Cr.Misc. No.16859 of 2018(2) dt.05-04-2018 2/2 Cr.P.C. vide Annexure-2 wherein she has not named the petitioners, she has only named Pintu. The victim is major as per medical report and, as such, the petitioners deserve sympathetic consideration.
The learned A.P.P. fairly submits that the victim has not named the petitioners.
In the facts and circumstances as stated above, the petitioners in the event of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned 1st Additional Chief Judicial Magistrate, Purnea, in connection with Mirganj P.S. Case No. 09 of 2018, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
