JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 47(a) of the Excise Act. 50 litres of sprit like material were recovered from the hutment of the petitioner.

It is submitted by learned counsel for the petitioner that the hutment in question was not a residential house. Moreover, the informant was not sure that seized article was sprit. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Let the learned court below consider the prayer for

Patna High Court Cr.Misc. No.56936 of 2015 (2) dt.17-12-2015 2/2 regular bail of the petitioner if he surrenders within a period of six weeks in connection with Pipra P.S. Case No. 249 of 2015 pending in the court of learned CJM, Motihari, East Champaran Accordingly, the application is disposed of.
