The petitioner is accused in connection with Gaya Kotwali P.S. Case No. 323 of 2016, registered under Section 366 of the Indian Penal Code.
The accusation is of kidnapping the minor daughter of the informant by this petitioner.
Learned counsel for the petitioner submits that the statemen of victim was recorded under Section 164 Cr.P.C. on 05.10.2016, in which, she stated her age as 20 years with contention that she had performed the marriage with this petitioner at Kali Temple according to her own sweet will as her parents wants to perform the marriage against her will. Patna High Court Cr.Misc. No.9742 of 2017 (2) dt.16-03-2017 is that petitioner is in custody since 01.12.2016. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya, in connection with Gaya Kotwali P.S. Case No. 323 of 2016. Out of two sureties, one surety must be the close relative of the petitioner.
