The petitioner seeks regular bail connection with S.Tr. No. 69 of 2019 arising out of Alamnagar P.S. Case No. 264/2018, registered for the offence punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation is that the petitioner was causing injury by firearm upon his grand-son and he died.

Learned counsel for the petitioner submits that the material collected during the course of investigation discloses that the petitioner has falsely been implicated in this case due to land dispute. Two witness have been examined during trial and there is no chance to tampering of the evidence by the petitioner. The petitioner is in custody since 31.12.2018.

On behalf of the informant, it is submitted that the

Patna High Court CR. MISC. No. 50633 of 2019(4) dt.03-02-2020 2/2 petitioner is named in the FIR. There is specific allegation against the petitioner.

The trial is commenced.

Considering the aforesaid facts, I am not inclined to enlarge the petitioner on bail.

The application is accordingly dismissed.

However, since the trial is commenced, the court below is directed to expedite the trial and conduct it on regular basis. The prosecution as well as accused persons are directed to cooperate in the trial for disposal of the case.
