The petitioners have renewed prayer for anticipatory bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act.

The prosecution case is that the petitioners and two other co-accused persons resorted to fire from the back causing injury to the father of the informant who subsequently succumbed to the injuries.

It is submitted by learned counsel for the petitioners that the first information report does not suggest that

Patna High Court Cr.Misc. No.39811 of 2016 (2) dt.01-03-2017 2/2 whose firing actually hit the victim. Moreover, the father of the petitioners, who was not named in the FIR, has been granted anticipatory bail.

Considering the nature of accusation and the fact that the case of the petitioners does not stand on the similar footing of those who have been granted anticipatory bail, this Court is not inclined to revise earlier order. However, let the learned court below consider the prayer for bail of the petitioners, if the petitioners surrender before the learned court below within a period of four weeks from today in connection with Dhaka P.S. Case No. 88 of 2014 pending in the court of learned Sub-divisional Judicial Magistrate, Sikrahana, East Champaran at Motihari. Accordingly, this application is disposed of.
