ANJANA MISHRA ORAL ORDER 17-11-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Jehanabad P.S. Case No.313 of 2016 for allegedly having committed the offence under Sections 420, 406, 409 and 120B/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is a Block Animal Husbandry Officer and also a Member of the Purchase Committee of the Cattle under the scheme of the NABARD. It is submitted that though the allegation has been levelled against him that he had issued wrong certificates for purchase of cattle, there is no complaint from any quarter regarding the sale/purchase of animals. It is further submitted that the sale receipts were issued by the Mela

Patna High Court Cr.Misc. No.40930 of 2016 (3) dt.17-11-2016 2/2 Organizer and the recipients of the animals have certified that the animals purchased from the Mela was, in fact, handed over to them. In view of such facts and circumstances, the petitioner prays for pre-arrest bail. He further submits that a similarly situated co-accused Ranjan Kumar, who was the Branch Manager of the Madhya Bihar Gramin Bank, has since been extended the privilege of anticipatory bail in Cr.Misc. No.34998 of 2016, vide order dated 29.08.2016.

Considering the entire facts and circumstances and also because the petitioner has no criminal antecedents, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jehanabad, in connection with Jehanabad P.S. Case No.313 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
