JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 04-10-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Siwan Muffasil (Mahadeva) P.S. Case No. 295 of 2016 registered under Section 47 of the Bihar Excise Act. The accusation is that in course of raid, 10 cartoon illegal country-made liquor each containing 45 pieces of 200 ml. from Scorpio and 12 cartoon illegal country-made liquor each containing 45 pieces of 200 ml. from Bolero as also 11 cartoon illegal country-made liquor each containing 45 pieces of 200 ml. are recovered from the eastern side of the house of the petitioner. It is also alleged that 2 cartoons illegal country made liquor each containing 45 pieces of 180 ml. recovered from the Deepfreezer.

Patna High Court Cr.Misc. No.38886 of 2016 (2) dt.04-10-2016 2/2 Learned counsel appearing on behalf of the petitioner submits that the vehicles from which the alleged illegal country made liquor is recovered, are not belonged to the petitioner. It is also submitted that it would appear from the F.I.R. that the petitioner is not apprehended by the Police on the spot. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Siwan in connection with Siwan Muffasil (Mahadeva) P.S. Case No. 295 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Rajendra Kumar Mishra, J) Shail/- U T
