JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-01-2016 The present application has been filed for modification of the order dated 01.12.2015 passed in Criminal Miscellaneous No.54259/2015 to the extent that father's name of the petitioner be read as "Chandeshwar Prasad" in stead of Ramprawesh Yadav" and the village name be also read as "Village-Anauli, P.S.-Bhagwanganj (Masaurhi)" which was recorded as "Gelhabigha, P.S.-Masaurhi". The said mistake perpetuated in the order since it was wrongly mentioned in the main petition and the Vakalatnama was also executed by the petitioner with the same name and address as given in the petition. Since the petitioner is not named in the FIR, hence, it is difficult to verify the petitioner's father's name, name of village and police station etc.
Under the circumstances, the order dated 01.12.2015 is modified to the extent that let the learned court
Patna High Court Cr.Misc. No.56603 of 2015 (2) dt.20-01-2016 2/2 below modify name of father, village and police station of the petitioner after going through the records of the case particularly case diary. The whole exercise must be completed within a period of six weeks from the date of receipt/production of a copy of this order.
Let the date of surrender be extended by further eight weeks calculated from the date of receipt or production of the order.
Accordingly, the modification application is disposed of in connection with Masaurhi P.S. Case No.99/2015, pending before learned SDJM, Masaurhi, Patna. (Dinesh Kumar Singh, J) Ashwini/- U T
