This application is for grant of bail in connection with Munger Muffasil P.S.Case No.69 of 2016 for the offence under Sections 25(1)a, 25(1-B)a of the Indian Penal Code. Submission of the learned counsel for the petitioner is that the whole allegation is not believable and even sanction has not been taken in this case and the petitioner is in custody for about 10 months.
Heard learned A.P.P. also, who has opposed the prayer for bail, stating that one Pistol and 250 cartridges were recovered form the possession of the petitioner.
Having heard both sides. From perusal of the seizure list itself, it appears that one Pistol and 250 cartridges were recovered
Patna High Court Cr.Misc. No.5744 of 2017 (2) dt.16-02-2017 2/2 from the possessions of the petitioner coupled with the fact that the petitioner is accused in two other cases of similar nature from before. As such, I am not inclined to grant bail to the petitioner, however, considering the fact that the petitioner is in jail for about ten months, the learned trial court is directed to expedite the trial and try to conclude it within a period of six months and if not concluded, the petitioner is at liberty to renew his prayer before the court concerned itself and the learned court below will pass appropriate order without being prejudiced by the order of this Court.
With the aforesaid observation, this application is dismissed.
