In this case, the petitioner is seeking anticipatory bail in connection with N.T.P.C. Khaira P.S. Case No.60 of 2017, registered for the offence punishable under Sections 379, 411 and 420/34 of the Indian Penal Code, under Section 3/4/5 of the Bihar Illegal Mines Act and under Section 75/80 of the Bihar Minor Minerals Rules.

Allegation has been made that the tractor of the petitioner was carrying the sand without proper authority, but Annmexure-3 annexed to this application shows the challan with respect to lifting of the sand.

Looking to the aforesaid facts, let the petitioner,

Patna High Court Cr.Misc. No.6117 of 2018 (2) dt.05-02-2018 2/2 namely, Krishna Singh, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, in connection with N.T.P.C. Khaira P.S. Case No. 60 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Shivaji Pandey, J) pawan/- U T
