The petitioner is accused in connection with Kochadhaman P.S. Case No. 194 of 2016 registered under sections 363, 366(A), 120B, 370, 371, 376/34 of the I.P.C. pending in the Court of Special Judge, Kishanganj. Learned counsel appearing on behalf of the petitioner submits that petitioner has falsely been made accused in this case due to village politics. He is innocent and has committed no offence. It is also submitted that petitioner is in custody since 20.09.2016.

Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner with submission that there is

Patna High Court Cr.Misc. No.15312 of 2017 (5) dt.04-05-2017 2/2 specific allegation of kidnapping and sexual assault against the petitioner.

Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected. (Arvind Srivastava, J) Shailendra/- U T
