The petitioner seeks bail in a case registered for the offence under Section 302 & other allied sections of the Indian Penal Code and Section 27 of the Arms Act.

It is submitted on behalf of petitioner that name of the petitioner has come during course of investigation on the allegation that he (petitioner) provided shelter and food to the co-accused persons in his half-constructed house. It is further submitted that there is no allegation of overt act against this petitioner and the half-constructed house in question is situated in an abandoned place and petitioner has nothing to do with the said house. Petitioner is in custody since 07.04.2021.

Patna High Court CR. MISC. No.64692 of 2021(3) dt.11-03-2022 2/2 Learned counsel for the State and informant opposed the bail petition and submitted that during course of investigation, it has come that this petitioner used to give shelter and food to co-accused persons.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge - V, Madhubani in connection with Sessions Trial No. 211 of 2021, arising out of Benipatti P.S.
