ANJANA MISHRA ORAL ORDER 02-03-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 147/ 148/ 149/452/380/353 and 427 of the Indian Penal Code. Learned counsel for the petitioner submits that the aforementioned case has been lodged by the Assistant Godown Manager of Bihar State Food Corporation, Khajauli alleging that on 13.10.2012, certain rowdy demonstrators came upon the godown and broke open the lock of the godown and looted away food-grains and other articles kept in godown. It is submitted by learned counsel for the petitioner that the petitioner was not named in the First Information Report initially, but subsequently, after a lapse of six months, his name has surfaced during the course of

Patna High Court Cr.Misc. No.755 of 2016 (3) dt.02-03-2016 P2/2 investigation. He further submits that certain other persons who were also not named in the First Information Report and their names had come later in this case, have been extended the privilege of anticipatory bail by this Court vide order dated 13.02.2015 passed in Cr. Misc. No. 6014 of 2015. Considering the aforementioned facts and circumstances and nature of allegations made against the petitioner, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Judicial Magistrate, 1st Class, Madhubani in connection with Khajauli P.S. Case No. 177 of 2012 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
