2. This application has been filed for modification of order dated 10.01.2024 passed in Cr. Misc. No. 73846 of 2023.

3. Learned counsel appearing on behalf of the petitioner submits that the petitioner was granted anticipatory bail on 10.01.2024 passed in Cr. Misc. No. 73846 of 2023 with a direction to surrender before the Court below within a period of six weeks from today, the petitioner be released on anticipatory bail upon furnishing bail bonds of Rs. 20000/- (Rupees Twenty thousand) with two sureties of the like amount each to the satisfaction of learned court concerned Kishanganj

Patna High Court CR. MISC. No.55940 of 2025(2) dt.31-10-2025 2/3 in connection with Bahardurganj P.S. Case No. 10 of 2023, giving rise to Special Case No. 18A of 2023, but due to some unavoidable circumstances, the petitioner could not surrender before the Court below within the stipulated time.

4. Learned APP for the State has vehemently opposed the prayer of modification of the order dated 10.01.2024 passed in Cr. Misc. No. 73846 of 2023 by submitting that the petitioner is a supplier of Smack. Learned A.P.P. for the State has relied in the case of Anarul SK Vs. The State of West Bengal (Special Leave to Appeal (Crl.) No(s). 12621 of 2024.) in which it is stated by the Hon'ble Supreme Court that the grant of anticipatory bail in cases involving Narcotic Drugs and Psychotropic Substances (NDPS) is a very serious issue and it further directed the State to consider as to whether it proposes to file an application for the cancellation of bail granted to the other co-accused who has been granted anticipatory bail.

5. In view of the matter, the petitioner was granted anticipatory bail on 10.01.2024 passed in Cr. Misc. No. 73846 of 2023 with a direction to surrender before the Court below within six weeks but the petitioner could not surrender before the court below within stipulated time without giving any cogent reason.

5. Accordingly, the modification application is rejected with a direction to the petitioner to surrender before the Court below within a period of six weeks from the date of receipt of this order.
